I don't believe he is criminally liable. The law mentions the original leaker, not secondary leakers. (Believe it was written this way to avoid 'complications' with the Third Estate).

On the other hand - Novak's reputation is at risk... if he becomes perceived as a partisan, willing to do 'hatchet work' for government types... even going so far as to endanger US Intelligence assets, and our WMD prevention program.
