That's the role of an appellate court. They aren't supposed to be doing equitable justice, harsh as that may sound. That's for the trial courts, who are closer to the action and hear the actual testimony. The role of the appellate court is to decide whether, on the facts as established by the trial court, the trial court applied the law correctly to the facts. Also, the appellate court has the role of clarifying and interpreting the law where it isn't clear, and sometimes of changing the law when they think it needs to be changed to meet contemporary circumstances.

True. Sometimes the only thing to do is make the best of a bad situation. But I will say, you seem to have turned out okay for all that.
