If he stayed below the radar he is still causing harm. Would I be in favor of the government going after him? No, because that would merely swell the ranks of people who might sympathize with mojo's desire to serve a limited clientele (and those people would have a variety of reasons for sympathizing, some of those reasons would be quite unsavory.) So, while I think the harm is there whether mojo is overt or covert- I wouldn't prosecute him unless he was overt about it.
