I agree with you that the feasibility of keeping something under the radar is iffy at best in practice, but I still feel like I have to try to find at least a theoretically feasible middle ground.

As for the case that Rambi provided, it seems to me that there's a reasonable judgment call to be made. If, in fact, there was significant fetal distress, then stressing the mother by enraging the father or by carrying him out in handcuffs and depriving her of his support at a dangerous moment would have been worse than excluding blacks from her care. At the moment of crisis, that is, not later. As much damage as was done by the tack they took, it would have been worse to kill the baby.
