You really can't make an argument that way, IMO. Every incident involves one grab, as in passing. Annoying, but not criminal.

If you were riding buses in Rome, that would happen on a frequent basis.

No, the legal issues, and I have no idea whether these incidents rise to that level, but the legal issues involve contemporary activities. If they talked with friends, counselors, relatives, etc., that counts as evidence. It may not be convincing evidence but it is evidence. The second part of the issues is whether there is a pattern; more incidents. That's why the Starr people worked so hard to find other incidents. Looks like, if someone decides to do something prosecutorial here, they'll have lots of incidents.
