The problem - legally, philosophically, perhaps even Constitutionally - is that the act of driving drunk in and of itself kills no one.

And you are correct, Andy: being drunk behind the wheel is certainly not a requirement for killing or maiming other people on the road. Nor is, for that matter, being high, being elderly, or talking on a cell phone.
