If for some reason I wanted to restrict my law practice to redheads, would there be anything to discuss in that?

There would be plenty to discuss. There are legal issues, moral issues, social issues. And psychological questions, too, I'd say. I'd sure be curious to know more about why anyone might want to do that. I've never "gotten" this thing about redheads. We could probably discuss that for weeks. What about a husband who insists no redheads be in the delivery room with his wife? I wonder if a hospital would honor that? Ah, but that would be speculation...

Regarding the substance of this issue, as you know, I take your point on the discrimination. But I think that discrimination doesn't necessarily trump everything, at least not at the margins. Mojo is operating at the margins. He is definitely in business so he has those obligations. But he is also a very small business operating in an especially personal type of service field. The size of his business and the "intimacy" of his service are both germane, IMO. One does not automatically trump the other. It is at least arguable that the intimate nature of the touching suggests different standards. I don't think I agree with that, but we've never really worked it through due to the unfortunate tone of the discussion. I am open to good arguments on either side although my sense is that massage would fall under the umbrella of medical treatment and should be treated the same.
