If you understand statutory construction, you will know that the legislature is given great deference and is only overturned if there is no way to read a statute to avoid a constitutional violation.

What constitutinal right is being claimed here?

Not freedom of religion -- Mojo has explicitly stated that this is not a religious issue.

Not freedom of association -- that doesn't apply to the commercial arena. (The reason the boy scouts are allowed to exclude homosexuals is because they are a private organization, not a business. If they had been found to be a business or a public accomodation, they would have lost that case.)

Not the right to privacy -- again, when you open a business you lose your privacy rights.

What's the constitutional issue?
