Yes, they are. And that is why Judicial fights have become the big thing in Congress."

I think the fights over judges in the Senate have more to do with the chance a conservative bench will over throw judicial activism. Most of the "litmus test" being given have to do with legal opinions that have the effect of law, but could never be passed into law by the legislature.
