Certainly, the claim has to be recognizable and susceptible of being evaluated, which limits the novelty.

In the case of discrimination, the criterion is fairly clear. The intent of the relevant statutes is to end a collusive regime of subordination and/or marginalization experienced by various minorities. The question is, would an exemption vitiate the intent of the statute? To do so, it would have to significantly undermine the operation of the statute. Surely, if too many exemptions were granted, there would be a problem, but rare exemptions shouldn't matter enough.
