The letter was a private inquisitive letter which asked IMA to justify its staking based on information in the Newmont data. It was not published, nor was it claiming right or stating materially found false fact. As such AQI is not sueable by IMA. IMA's action is frivolous and without merit on the face of it. AQI has no responsibility to IMA to adjust its business and its legitimate inquires to suit IMA's aims and needs in business. My prediction is that IMA's suit will be dismissed quickly as its legal foundation is quite weak. It is obvious that IMA launched the suit to protect its stock price, and take the high ground before it could further its position with speculation. I predict that this strategy will fail and lead AQI to launch a countersuit to protect itself. Although it is a principle that innocence may be loud in crying foul, it is often true too, that people try to obfuscate perceptions of guilt by making a lot of noise.

LEGAL ACTION COMMENCED AGAINST AQUILINE
IMA Exploration has initiated a legal action in the Supreme Court of
British Columbia against Aquiline Resources claiming damages, an injunction
and costs for injurious falsehood, interference with contractual relations,
interference with economic interests, defamation, and negligence arising
out of the defendant's issuance and publication of a letter sent to IMA on
the same day that IMA was to have closed a bought-deal financing. As a
direct consequence of that letter, IMA's shares lost value and the
financing was cancelled.
The company will proceed with the planned exploration program on Navidad,
as well as other properties, as previously scheduled. IMA Exploration has a
strong treasury in excess of $4-million to finance its exploration
objectives.
