Effectivly it did legislate. It went beyond the law and imposed a very specific requirement that was not contained in the original law and that was not the only way to get the law enforced. Yes officially they interpreted the law, but in effect they did create law. This looks like a duck and quacks like a duck. It also swims in a lake and leave duck droppings all over.

At this point, we are quibbling over fine points. Rather than say they created new law, it would be truer to say they have expanded existing law. However, they have gone beyond their normal interpreting-of-the-law duties.
