Juries and judges decide settlements -- not legislatures.

Do you want to eliminate the jury/judge-based system?

If juries/judges believe that cases are frivolous -- they would not allow for the awards would they?

Your a juror as am I, as is the guy at work, as is the priest at your church and so on...

Apparently your wiser then ALL these individuals who took time away from their personal lives to sit in on a case and get every last detail from both sides. Either every juror is a complete moron or the defense has horrible attorneys -- which is it?

Its simple: If a defendant thinks they are innocent/smeared or that the case is clearly frivolous -- then they should have no issue in defending, making that very case in a courtroom.
