IMA might well have done this. But as I said in my previous message, you and I do not know the details. We will find out.

At this point in time, based on what we know, unless AQI management has been really stupid, they sure seems to be on the good end of the stick. Their action appears to be defendable while IMA has yet to show evidence that theirs is.

But I will admit that things can change.

IMA wants to do a PP to get some money. AQI sends IMA a letter saying they want IMA to explain what knowledge they used to justify staking Navidad. The PP collapses. In sending the letter AQI knew this thing was going to court as no one in this business should be stupid enough to think such an action would not go to court.

IMA, even if guilty, would be stupid to give AQI anything without a court order. The correct course of action is to tell AQI to put up or shut up on the issue, hence the lawsuite.

If AQI has something they will countersue, but if they don't they are either stupid or have bad lawyers, both of which could be possible as the world is full of stupid people and bad lawyers. If AQI backs down, the cloud will be lifted on IMA and the PP can continue, but we will then know they are stupid and/or have bad lawyers (bad = stupid, corrupt, greedy, chitty etc).

This chit happens every day all over the globe in every industry known to man. The ball is currently in AQI's court, expect some action from them in a few days.

All parties perusing the Newmont offer would have looked at the same data package and have been bound by the same confidentiality.
