in this state, it is exactly that, a standard contract that is put together by a team of attorneys in such a manner that is fair and reasonable to all parties concerned. RE agents have the privelege of "filling in the blanks". Going beyond that, agents are then held to the standards of an attorney without a license to practice. This is a huge gray area since nearly all transactions are amended to some extent.

Attorneys are able to utilize these contracts supported by the local board without having a memberhsip. In most transactions that involve attorneys, these exact documents are used because they are standard and easily (?) understood by all parties.

Typically, where the confusion begins happens to be non-standard forms.

Attorneys can muddy the waters and generally do so. But so can any party to the transaction.

Why are attorneys not required in California? That is a good question! The answer is simple - Politics>>

Perhaps the reason attorneys are required in so many states is simple - politics! FWIW, the lawyers have one of the strongest lobbying bodies in California, far stronger than the real estate agents. I think that is true in most states.

I always felt a lot more relaxed and comfortable when my client had his own legal representation. Sometimes they had to get one because the other party in the transaction was raising a big stink over something and nothing would get settled without legal help. Sometimes they just bring their own lawyers to settlement routinely--especially corporate executives who come equipped with company lawyers.
