Jacob, you need to read my post to ken as to why the POWs are not to be considered criminals but combatants and therefore not entitled to the protection of the criminal law's safeguards.

They may be arguably entitled to the treatment required by the Geneva Convention, which they are likely getting, anyway. I personally think that they are not entitled to such treatment because they do not wear uniforms, commit random acts of warfare against civilians, and otherwise do not identify themselves as combatants. Moreover, no nation or organization that is a signatory to the Convention claims to represent them by invoking its terms. There's a rich bit of irony there, by the way.

They are (probably) screwed legally. And properly so, in my view. You don't play by the rules, don't bitch when they aren't applied to you for your benefit.
