First you have to have a feared Enforcement Agency to garner respect for rules. And nobody from Hedge Fund managers, to Mutual Fund managers, to Analysts, to 13 year old Yahoo's fear the SEC as it currently is. The agency charged with the duty to police the market is a total joke. The fines, and penalties they levy aren't even enough to scare 13 year olds when compared to the windfalls that await the right scheme.

And thats a sad, but amazingly true fact.

They are going to have to actually shut someone like Putnam or a major broker down ala Arthur Andersen before respect for the rules is gained back. And I'm not holding my breath on that. (Only the Accountants could have such a poor lobbyist to allow such an event to occur.)
