Yes, but the reason I used the "fire in a crowded theater" analogy is that it involves speech and free speech is normally presumed to be a right. It was a response to Karen's question about "why it's OK to compromise the rights of a citizen on behalf of a non-citizen." Molestation of nursing students isn't normally presumed to be an American's right, so I assume Karen wouldn't have accepted that point as having answered her question. I do however think your point is a valid one and relevant to this discussion. I was just trying to deal with a more specific question.
