No witnesses except the participants, no evidence that there was any force or threat. Its totally "he said, she said".

I think an assault charge is questionable.

If there is no punishment the school system doles out for such things when they are consensual I'm not sure he should recieve any punishment, at least not any punishment by anyone besides his parents. If there is a punishment for such things if they are consensual then I suppose he could get punished for that and the girl could avoid the punishment because it can't be proved that she willingly did anything.

There were no witnesses, although during the program someone called in and said there was one who said it was not consensual.

So either there was a witness or there was not. That could make a lot of difference...
