An Update:
• Judge tosses out Bursey’s subpoenas

Political activist Brett Bursey has lost his attempt to force U.S. Attorney General John Ashcroft and other senior Bush administration officials to testify at his trial.

Federal Magistrate Bristow Marchant agreed with the U.S. Justice Department’s efforts to block subpoenas Bursey’s lawyer filed.

The government called Bursey’s subpoenas “politically motivated.” That is what the activist calls the government’s prosecution of him for refusing to move to a “free-speech zone’’ during Bush’s visit to Columbia last fall.

Bursey’s trial is scheduled to start Wednesday in the Perry federal courthouse.
