Well, no constitutional law scholar myself, perhaps I missed something. Please show me where the framers said "advise [sic] and consent" necessarily means an up or down, simple majority vote as opposed to leaving it up to the senate what rules it should follow internally. And while you're at it, can you show me where, in the constitution or in the debate around its framing, the subject of the filibuster's applicability to advice and consent comes up?

I'm not trying to be difficult or to defend the Dems' behavior, mind you - I just don't see the constitutionality of it the same as you.
