I believe the reasoning for the MTBE protection, is that MTBE was required by law to be added to some gasoline. I recall that Governor Davis talked about suing the Federal Government, when the Feds ordered removing MTBE from CA gasoline and replacing it with ethanol (he was against removing MTBE from gas too quickly).
