The SPD (social democrats) at least were present, although not in full number: the votes of the catholic center allowed the change of Bundestag rules, so all the missing members of parliament were counted as present. Only through this additional loophole the two third majority, needed for the constitutional changes, was achieved. votes for: 444 - NSDAP, DNVP, center votes against: 94 - SPD 81 members of the communist party were de facto fair game after the Bundestag fire 26 members of SPD were arrested or on the run.
