Barrick Allowed to Sue Blanchard in Ontario Court (Update1)
Dec. 9 (Bloomberg) -- Barrick Gold Corp., the world's third- biggest gold producer, can proceed with a defamation lawsuit in Ontario against a Louisiana coin dealer that accused the Toronto- based company of manipulating gold prices.

Ontario Superior Court Justice Ian Nordheimer denied a dismissal request from Blanchard & Co., in a ruling released today and e-mailed to Bloomberg News. Blanchard had argued that the Ontario Superior Court lacked jurisdiction and wasn't a convenient forum.

Barrick is seeking C$200 million ($153 million) in damages after the coin dealer alleged in news releases that Barrick and J.P. Morgan Chase & Co. made $2 billion in illegal profits by manipulating the price of gold with sales of bullion borrowed from central banks. Blanchard is suing Barrick and J.P. Morgan in Louisiana.

``There is a clear unfairness to the plaintiff if Ontario declines jurisdiction as the plaintiff is not only then precluded from litigating its claim in its home jurisdiction, it loses all of the benefits of the more favorable libel laws which would be applicable to its claim,'' Nordheimer wrote in the ruling.

No date has been set for the lawsuit, Barrick spokesman Vince Borg said. Blanchard spokesman Neal Ryan declined to comment on the decision, saying the company hasn't had a chance to review it.

Barrick shares fell 60 cents to C$28.65 by the 4 p.m. close of trade on the Toronto Stock Exchange.

Got stopped out again. What a frustration day.<G> But, I am still up beat about the gold stocks. Any new views out there?
