Whichever why this goes, they need it out of the way early in the year. Defying FACA was mind-numbingly dumb, the single dumbest thing the Administration has done, IMO. So much risk for so little gain. It's hard to believe they're letting this process play out so close to an election even if they have reason to believe that the Supremes will dump FACA. Of course, every administration and a whole bunch of civil servants would be thrilled to see FACA gone...
