I doubt the 9th Circuit has much credibility left. The Supremes will doubtless override with a more nuanced version - if you are going to designate US citizens on US turf "enemy combatants", then we, the court, damn well need to see your evidence of a bona fide national security threat. Otherwise charge'em like mobsters.
