Funny... I expect better arguments out of Professor Cole..

Many of the concerns he cites (lack of constitution, never been done before, stage for enemy propaganda) were all issues in the Nuremburg trials.

Hell, they're concerns in many public trials we've had in recent history, especially with regard to hate crimes, or racially charged matters.

But what Mr. Cole FAILS to cite is the danger in NOT forcing the Sunni clans to face their complicity in waging genocide against Iraq's other two ethnicities.

Were it me, I'd require every Sunni clan leadership group to visit those mass graves. Force them to stare at the human remains of thousands of Shiites and Kurds they played a part in murdering..

But they will be seeing it all on Iraqi TV, as will the rest of the Arab world. And any rambling by Saddam that does not specifically address his defense against those charges will be objected to by the prosecution and sustained by the court.

Not putting him on trial and rendering his name, his clan, and his posterity the humiliation and scorn they deserve is far more dangerous.

Then we can approach the other Sunni tribal leaders and say "we have information on you guys too.. Should we put you on trial as well, or are you going to 'play ball' ".
