Yes and no. The language, rather than forcing plants to upgrade, allowed them to delay upgrade until such time as other improvements were made. Now that time has passed and the bill has come due, the proposed change was allowing the old plants to avoid the upgrades entirely. So, while the CAA delayed the upgrades, the proposal will obviate them.

Whether or not the court overstepped and whether or not it is overruled on appeal, I don't think that continued production from those dirty old plants is the outcome we want.
