Last time I looked, the vast majority of cases are settled out of court anyway. In fact, most are settled informally without filing a case in court.

Insurance companies are pretty good at assessing liability, and they hate paying insurance defense lawyers if they don't have to.

If I can get my client more money than she could have gotten on her own without me, what business is it of anybody but her and me what she pays me?

In my experience, tort reform always gets put on the front burner when the economy is bad and/or the stock market is bad - when insurance companies are rolling in dough, they don't complain about lawsuits. Without lawsuits, they'd have no reason to exist.

As the old saying goes, the only lawyer in town goes broke, to prosper; you need at least two. ;^)
