Virginia has a fund for birth-related neurological injuries, so we don't have cases like that. We also have a $1.5 million med mal damages cap - unfortunately it caps both compensatory AND economic damages - all damages against all defendants for the same or related injuries, whatever the legal theory - although cases that are potentially over the cap are actually few and far between.

My first cousin has neurological damage that is probably due to hypoxia at birth - the nurses squeezed my aunt's legs together to keep her from giving birth until, the doctor got there. Crazy, no? But a tragedy for the family.
