Good observations and I don't know the answers. I do however, think the BOD should be held more accountable and some of the laws are certainly moving that direction. (Sarbanes-Oxley)

I also think that if more of us took on more personal responsibility for our health that the situation wouldn't be as problematic as it is. Most of us certainly can do a lot to take care of the health that we have. That is worth infinitely more than all of the government sponsored health care plans laid end to end.

capping the benefit of someone who should be compensated for their loss.

It is my understanding the cap is on the punitive damages awarded to the plaintiff, not the actual damages. Actual damages are awarded in full. The cap is on the obscene punitive damages awarded by juries who do not realize they(we) are the ones who pay, in the long run. In many case the money left to the plaintiff is less than that taken by the attornies.
