Funny to hear you say that because I had someone argue a while back that they didn't see how the public who was in 401ks and the like could ever achieve the kinds of returns that the venture capital funds receive because most individual investors weren't qualified investors and thus not allowed to play there. I thought it was funny simply because I operate completely in the public markets and I know that the same returns are available there. So what people need to do is get divorced from their 401ks that have such limited options. Of course all the laws on 401s are there to protect the naive investor from excessive risk. Risk goes both ways, you cannot have superior returns without risk. If you avoid risk you also avoid superior returns. This is what all the LTCM guys knew but they thought they were smart enough to beat it.
