Ah, but Madam Counselor, surely you remember the significance that concept: The John Peter Zenger Case established it as a legal concept in American law. Prior to that, a publisher could be jailed and charged with libel or sedition whether or not what he printed was true. Simply the fact that it harmed the reputation of the governor or government was sufficient.
