Getting a constitutional amendment passed is unlikely imo. Even if Mass does it will take effect at its earliest two years after gay marriage is allowed. Thus if there is less of a problem or less voter opposition even the Mass amendment ultimately is unlikely to pass the legislature twice. I think the courts are wrong here but i do see Sullivans point lumping in Brown, and this decision and possibly rowe v wade. Judicial activism is judicial activism. And actually i hope that sullivan is right about gay marriage making the gay community more mainstream. Mike

Sad a smart guy like Sullivan can't see the writing on the wall on this. Too much opposition. He won't win.

Too my mind, civil unions were the way to go on this. Get the steak, and leave the sizzle for another time. Civil unions would get the insurance & other legal rights that homosexual couples really need. I know why the symbolism of a legal marriage is important to them. But for the same reason, the rest of society has to be agreed that it's ready to move homosexuality from the "tolerated" category to the "normal" category. And the rest of the society just isn't there. Some of them won't ever be there. Most could get used to the idea with time. But that's why it would have been better to have civil unions until most people said, this is silly, just let them get married.
