OK I got it. So what happens when the legislature and courts in a state come to blows? Can the legislature in a state, overturn a court ruling without an amendment? I dont think so. But i see your point and I guess it could influence some future decisions and appointment of judges.
By the way i am torn on this gay marriage issue. I value the opinions of sullivan and brooks on this issue. If i were a judge, i am uncertain of what i would decide?
How do you think the current SCOTUS would rule when the Defense of Marriage Act is challenged? My guess is 5-4 against the DMA<g> act.

The courts can always be ignored. Recall what Andrew Jackson said, "Justice Marshall has made his decision, let him enforce it now if he can."
