Karen - or any of our lawyers on the thread:

Setup:

Lunch discussion about same-sex marriage turned to the normal points we discuss -> if the feds stay out of the bedroom on this - how can they maintain constraints on polygamy and incest...

Then it got funny. Someone brought up the issue of common-law marriage and when it was defined, one of the guys said - how do you differentiate long standing roommates if one files for divorce benefits claiming a same-sex common law marriage?

His point was his college roommate and he shared a household for 7 years. He is now doing very well and his ex-roommate is not. If same-sex marriage is permitted, do we get same-sex common-law marriage?

He never discussed being anything other than a roommate with the fellow. But would that even matter?

John
