Because the War Powers act does make a unilateral declaration of war, by the president, constitutional. I believe the congress, has so many days to repeal said declaration of war.


The War Powers Act makes it possible for the US president to commit American troops to hostilities but it hardly authorizes him to unilaterally declare war:
