I don't see where the any one of these criteria is in the Geneva conventions you posted. It seems to be your personal interpretation and it is clearly incorrect. Here's the relavant section. The list of criteria (2a through 2d) should ALL be met not just any one of them.2. Members of other militias and members of other volunteer corps, including those of organized resistance movements, belonging to a Party to the conflict and operating in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movements, fulfil the following conditions: (a) That of being commanded by a person responsible for his subordinates; (b) That of having a fixed distinctive sign recognizable at a distance; (c) That of carrying arms openly; (d) That of conducting their operations in accordance with the laws and customs of war. Next:Another point you have chosen to ignore is that the Geneva Convention states very clearly that if any doubt .. I don't see the grounds for doubt. So I don't consider this relevant. What, exactly, in your opinion, is the difference between the Iraqis captured during the invasion of Iraq who fought US forces and the Afghans captured during the invasion of Afghanistan who fought US forces that one merited POW status and the other didn't? There are a number of differences. Iraq had a internationally recognized government. The Taliban was not internationally recognized - except by one or two countries. Actually the Afghan Northern Alliance was the remnant of the last internationally recognized government there. And of course, Iraqi soldiers met ALL the criteria listed below:(a) That of being commanded by a person responsible for his subordinates; (b) That of having a fixed distinctive sign recognizable at a distance; (c) That of carrying arms openly; (d) That of conducting their operations in accordance with the laws and customs of war. So clearly Iraqi soldiers captured are POW's. Lastly, I'd like to express my resentment at your advocacy for the captured Al Qaida members at Guantanamo. The fatwa Osama bin Ladin issued calling on Muslims to kill Americans wherever and whenever they can is well known. And the resulting religiously based commitment of these Al Qaida members to fulfill the fatwa is equally well known. I am outraged that you are looking for legal loopholes to set these people free so they will be enabled to commit future attacks on my country and my people.
