On the Away Without Official Leave scandal.

The argument the right seems to be sticking to is that he was not guilty. Does that mean they are claiming he is not guilty because he was never AWOL or because he was never charged and found guilty and therefore is not guilty.

Scott McClellan said in one of the press conferences which covered this subject that the papers showed Junior was there because in order for him to receive pay he had to have showed up. That is true if the records which have been released are accurate. They show Junior did receive a paycheck for several months which were in question. They also show about a 5 month period in which he did not receive a paycheck. Assuming the records are accurate this means Junior was not there for approximately 5 straight months. If he wasn't there did he have official permission not to be there? If he had official permission surely there would have been a document in his file which proved this. Since the Whitehouse claims these records are complete I don't see how anyone can come to any conclusion but that he was Away Without Official Leave for the period in question or the records would show otherwise.

How long does a member of the National Guard have to be away before he can be charged with AWOL? Was Junior away for that length of time? Since the records released show he wasn't paid for the period in question he must not have been there or he would have been paid.

Now since he was never charged with being AWOL does this mean he is not guilty of being AWOL or does it merely mean he was never charged? If he had been charged with being AWOL could he have been found guilty? I think the records show that the National Guard would not have had any trouble convicting him of the crime.

How long does a person have to shirk their duty before they can be charged with being a deserter? The length of time which the records show Junior did not report for duty is longer than the time missing until a person can be charged with being a deserter. I think that most members of the Guard at that time would have had a tough time proving they had not deserted, but considering who Juniors daddy was and the amount of money and resources he would have been willing to invest in the case I don't think Junior would have been found guilty of being a deserter.
