Your analogies would stand if the cops and the prosecutors were actively encouraging, and acting as accessories, to the crime. This isn't a case where the law said gay marriage wasn't prohibited, then the city failed to enforce a new law that prohibited that marriage. We have a situation where something is specifically and clearly proscribed, and the Mayor is deliberately and actively encouraging the breaking of that proscription and the issuance of, under state law, false documents.
