Yes, I'll agree with that, on the law. Just not the rights part of it.

So, if the courts decide that homosexuals do or don't have the right to marry, no amount of majority overrule can work. That is why the conservatives want a Constitutional amendment; because they realize the courts would be ruling on a right and not ordinary law, they know the only way to 'trump' a SC ruling is to change the Constitution.

The question is: if the SC rules that gays can marry, how to design such an amendment?
