How about that?

A constitutional amendment can still be passed, even if the courts grant homosexuals the right to marry in the meantime.

There are some people that believe that this is a bad time for the activists to be trying to do this. They may win the battle, but will lose the war. It also will hurt the dems ability, this year in particular, to elect a president.
