I think that may be the compromise, if it comes down to it. The legal protections is sticky. Does that mean all the same marital rights? For example, can both partners adopt their children, so that if one dies, the child is not torn from their remaining parent? Inheritence? Health benefits? etc?

I don't think that most gay people want to force the ability to be married in, say, a Catholic church. The choice of who to marry should still be up to the church. But, if a church does want to marry a gay couple, they should be allowed to.

But, I don't think that compromise will be acceptable to all sides. So, I guess it's a SC showdown...
