It's a 14th Amendment Equal Protection issue in the last analysis i think so too... and that's why i think the politicians feel it's necessary to do an "end run" (for lack of a better phrase) with a constitutional amendment. but make no mistake about it...i doubt any politician really wants to go in this direction, but many feel their hand has been forced by the acts of the mass supreme court and now the mayor of san francisco
