What is over the top about using the legal system to try to enforce the law?

It's the political season. The left shot themselves in the foot by bringing this up now, it's terrible timing for them.

And it seems to me the fight is all about nomenclature. Civil unions give them everything they want as far as mutual benefits go, but they had to go and push the envelope.
