I say this, if it is such a "harmless error" then Varian should have no problem at all with going back to retry the case!
As far as the timing on filing an anti-slapp Motion to Strike the keyword is "may be filed within 60 days". Common law in Mattel v. Luce has enforced this and Ms. Renfrew describes the situation well in her amicus letter she wrote in support of our Petition for Review. See it here:
