I was thinking about other issues where there have been cries of judicial activism. The noise started, as I recall, with the SC finding segregation unconstitutional. Most civil rights issues cause such an uproar, it seems. Incorrectly, IMO. I have no problem with the SC's judicial review of state laws that violate the US Constitution, but I don't know that they're always right in their interpretations. It might be useful if those who complain about judicial activism either had to put up, by means of a constitutional amendment to constrain interpretation in specific areas, or shut up.
