No doubt the founders did not intend for judges to legislate from the bench, but you know these liberals have a dynamic ever evolving view of the constitution. Conservatives lose ground every year no matter who is in office. Some years are just worse than others. At least with my religious beliefs, I believe there will be justice in the end.
