Gemstar says has not dropped appeal to ITC ruling

LOS ANGELES, March 9 (Reuters) - Television program guide provider Gemstar-TV Guide International Inc. (NasdaqNM:GMST - News) has not dropped its appeal of a 2002 International Trade Commission ruling, despite a court notice to the contrary, a spokeswoman said on Tuesday.
Early Tuesday, the U.S. Court of Appeals for the Federal Circuit, in a disposition sheet posted on its Web site, said Gemstar's appeal against the ITC had been dismissed. Later in the day, a correction to that sheet was posted removing Gemstar's case from the dismissals list.

The spokeswoman said the dismissal notice for the entire case was posted in error after Gemstar and Pioneer Corp. (Tokyo:6773.T - News) moved to dismiss only their claims against each other pursuant to a recent settlement between them.

Gemstar filed a complaint with the ITC in early 2001, alleging that a number of companies were building television set-top boxes with technology that infringed on Gemstar's program guide patents and importing those boxes into the United States.

An administrative law judge ruled in June 2002 that the patents were not violated. The ITC declined to review the judge's ruling in August 2002, leading to Gemstar's appeal.

Shares in Gemstar fell 7.6 percent to $7.16 on Nasdaq.
