Bush declared war on Iraq Bush did no such thing. and then asked Congress to rubber stamp his plan of action. Its not a rubber stamp. They are under no obligation to approve his proposals. That is not what the founding fathers intended. Bush didn't invade Iraq before Congress approved. I suppose you could claim the approval is not a formal declaration of war but the Constitution doesn't say that no military action can be undertaken by America absent a formal declaration of war. Also no war has been declared by the US since WWII and many of our military actions (including actions very early in the United States history, while the founders where still alive) before WWII where not part of a declared war.
